Electronic Communications

When you visit S.W.A.G or send e-mail to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices anywhere on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

 

 

 

Warranty Service

We warrant each S.W.A.G computer system and its parts against defects in materials or workmanship for three years labor (desktops) or one year labor (laptops) and one year parts from the original date of invoice. During this period,S.W.A.G will repair or replace defective parts with new or reconditioned parts at S.W.A.G option, without charge to you.S.W.A.G warranty does not cover replacement of engraving. In the event your engraved system receives service, use of necessary replacement parts may eliminate the engraving on the system. All original parts replaced by S.W.A.G or its authorized service centers, become the property of S.W.A.G. You are responsible for the payment, at current rates, for any service or repair outside the scope of this limited warranty.

 

 

S.W.A.G, makes no other warranty, either express or implied, including but not limited to warranties of merchant-ability, fitness for a particular purpose, or conformity to any representation or description, with respect to this computer other than as set forth below. S.W.A.G makes no warranty or representation, either express or implied, with respect to any manufacturer’s product or documentation, its quality, performance, merchant-ability, fitness for a particular purpose, or conformity to any representation or description.

Price, specification, and terms are subject to change without notice. S.W.A.G is not responsible for errors in typography and/or photography.

 

Customer pays return shipping on all services.

Shipping Dispute: Title and Risk of Loss

 

S.W.A.G will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s) – except software – and risk of loss passes to the

Customer upon delivery to the carrier. S.W.A.G reserves a purchase money security interest in the product(s) until its receipt of the full amount is due. The Customer agrees to allow S.W.A.G to sign appropriate documents on the Customer’s behalf to permit S.W.A.G to protect its purchase money security interest. Title to software will remain with the licencor(s). All software is provided subject to the license agreement of the software maker. The Customer agrees to be bound by any software license agreement once the seal on the package is broken. S.W.A.G will advise the Customer of estimated shipping dates, but S.W.A.G will, under no circumstances, be responsible for delays in delivery and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state, or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.

 

 

 

Sales Tax

Sales tax is required for orders shipped within our resident state, Kentucky. All orders shipped within Kentucky will be charged the applicable sales tax in accordance to your county. Will-Call Pickups will be charged our local tax rate of 6.00%.

 

 

 

Sales tax is also required for orders shipped to the state of Washington. All orders shipped with Washington will be charged the applicable sales tax in accordance to your city.

 

 

 

Electronic Waste Recycling Act

The Electronic Waste Recycling Act (“Act”) became law in Kentucky on January 1, 2005. The primary objective of this law is to initiate a recycling program for computer products containing chemicals deemed hazardous to the environment. To fund this program, Kentucky requires retailers and e-tailers to collect, on the State’s behalf, a fee for each product covered by this law. The fee is paid by the consumer at the time of purchase of the covered product. This fee will be remitted directly to the State and only applies to orders shipped within California.

 

The types of products that we are required to collect this recycling fee include flat panel screens and other similar video display devices. The actual amount of the recycling fee will vary, based on the screen size of the product when measured diagonally, as follows:

 

Greater than 4” and less than 15” -- $3.00

Greater than or equal to 15” -- $4.00

Greater than or equal to 35” --$5.00

 

 

Pricing Policy

Unfortunately, we do not offer price matching. For your convenience, all our most current and lowest pricing is posted on our website daily. Prices are non-negotiable.

 

 

 

We make every effort to list the most accurate, up to the minute information. Despite our efforts, some items on our website may be mis-priced. If a product is listed at an incorrect price due to a typographical, photographical, or technical error or error in pricing from our vendors, S.W.A.G reserves the right to refuse or cancel any orders placed for a product listed at the incorrect price.

 

 

 

Mail-In Rebates

For your convenience, S.W.A.G does its best to advertise any current rebates on our website. The prices listed on our website do not include rebate savings. Any use of these rebates is limited to any terms and/or conditions as determined by the manufacturer. If you have any questions regarding the rebate terms and conditions, please contact the manufacturers directly.

 

 

 

OEM vs. Retail

The retail and OEM versions usually are essentially the same product. However, the retail version usually comes with bundled software, retail packaging, and more bells and whistles so to speak. OEM (Original Equipment Manufacturer), also known as White Box or Brown Box versions, will come with the actual product and drivers, but no special packaging or software.

 

 

 

30-Day Satisfaction Guarantee 

S.W.A.G offers our customers a 30-day satisfaction refund guarantee on all purchases (please refer to the Purchase Agreement and/or Warranty Statement for additional details), except: any routers, software, or any specially ordered items. Systems with case engravings may not be returned for refund or exchange under any circumstances unless they contain defects in materials or workmanship. To take advantage of S.W.A.G’s return guarantee policy, the Customer agrees to comply with S.W.A.G’s Product Return Procedure, as stated in the Purchase Agreement and online Warranty Statement. Any breach of S.W.A.G’s Return Policy Procedure may result in the loss of S.W.A.G’s replacement/return guarantee. Furthermore, all return shipments not in compliance with these instructions may be rejected.

 

 

 

Return Policy

 

All merchandise (unless otherwise specified) carry a 30-day Satisfaction Guarantee* from original invoice date

Restocking Fees will not be assessed within the first 30-days from purchase. Any returns for refund after 30-days are subject to a 15% restocking fee. Refunds will not be approved after 45-days from delivery.

Shipping and Handling Fees are NON-REFUNDABLE.

For items sold with “FREE SHIPPING”, there will be an additional $50 deduction after any applicable restocking fee is applied.

 

 

Processing Time

Without any Rush options selected, you can expect your order to be processed within 1-2 days and shipped approximately 5-10 business days. Orders will not be processed on weekends and/or holidays. E-mail updates will be provided as your order progresses through the various stages.

 

 

 

Rush Orders

We will only process next day rush orders for an additional fee provided that the following conditions are met:

Order is placed before 12 PM EST

Applies for delivery to the domestic U.S. 48 states only

Order transaction and credit card authorization must be successfully completed before 4:00 PM EST

 

 

Order Status

S.W.A.G will do everything possible to keep you informed of your order via e-mail notifications. Your tracking number will be e-mailed to you the night your item has been shipped. It is the customer’s responsibility to track the package and be available for the delivery. You may view your order status by logging into your S.W.A.G account.

 

 

 

Change or Modify Orders

You may request a change to your order, provided your order has not already shipped. Please call our sales representatives at (502) 316-9191 during our business hours to change your order. You will be asked to provide your order number, so please ensure you have that information available when you call. To ensure efficient processing, all order changes must be requested by phone.

 

 

 

Cancel Orders

You may request a cancellation of your order, provided your order has not already shipped. For engraved products, once a system side panel has been engraved, any order cancellations are subject to a 15% restocking fee. Please call us at (520) 316-9191 during our business hours to change your order. You will be asked to provide your order number, so please ensure you have that information available when you call. To ensure efficient processing, all order cancellations must be requested by phone.

 

 

 

Purchase Agreement

Every time you make a purchase on S.W.A.G, you will be asked to read and accept the terms listed in this Purchase Agreement.

 

 

 

Governing Law and Jurisdiction

 

Any dispute arising out of or related to these Terms and Conditions or the sales transaction between S.W.A.G and Customer shall be governed by the laws of the State of Kentucky, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. S.W.A.G and Customer consent to the exclusive jurisdiction and the venue of the State Courts of the State of Kentucky, Scott County, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against S.W.A.G that is more than one year after the date of the applicable invoice.
